Terms & conditions


1. General provisions

a) All orders placed are considered binding. Buyer accepts the Business Terms and Conditions for delivery of the goods declared by the Seller. Buyer and seller's relationships are governed by these terms and conditions, which are binding on both parties unless otherwise stipulated in the agreement. 2. Order of goods

3. Price and payment

a) The bid prices listed in our online shop are valid at the time of ordering. The purchase price will be considered to be paid only after payment of the total price by cash on receipt of goods by the buyer or by cash payment at our premises or paid to the current account of the seller. 4. Delivery time

(a) The delivery period begins to run from the date of receipt of the binding order, subject to receipt of all the documents necessary for timely delivery. The delivery period will be extended proportionately to circumstances if the delay is caused by force majeure or circumstances not caused by the seller.

5. Transport conditions, transport

8. Warranty

a) The warranty period begins to run from the date of delivery of the goods to the buyer. The seller provides a guarantee for the quality and completeness of the delivery. If the Buyer discovers defects in the receipt of goods, he / she must always communicate these facts in writing and in a recommended manner without undue delay.

b) The claim sheet must include the date of delivery of the goods, the name of the product, the amount complained of, the description of the defect and the claim for the settlement of the claim. The seller is obliged to comment on the claim within 30 days of receiving it.

c) As a consumer, the buyer has the right to withdraw from the contract within 14 days without giving any reason. Goods must return intact and in original packaging. In the event of withdrawal, the buyer shall pay the operator a handling charge for the transport of the goods and the costs incurred by the carrier.



9. Complaints

a) Each product is subject to the statutory warranty period + our extended warranty, which is a total of 30 months for drives and for other goods such as control electronics, remote control and additional pulse and security features, is a statutory warranty period of 24 months. The warranty is based on all apparent and hidden defects of goods that are incompatible with the functionality of the goods, their utility and aesthetic qualities.

b) The buyer is obliged to inspect the goods without undue delay after its takeover, which means the transfer of the goods by the carrier to the customer.

c) A proof of purchase is required for the claim.

d) Information about the progress of the complaint is sent by e-mail to the address indicated by the buyer. The complainant's address is the same as its headquarters.

e) Buyer can send the defective goods on the complaint to the shipping company - at his own expense - to the company address. The package must be marked "REKLAMACE" and include: Claimed goods (including complete accessories), a copy of the purchase document, detailed description of the defect and sufficient contact details of the buyer (return address, telephone number, e-mail).

f) The return trip (after a legitimate complaint has been settled) is paid by the operator. In the event of an unjustified claim, the Buyer will be charged a handling fee according to the current price list and the goods will be sent to the buyer's expense and risk at his address.

g) Depending on the type of defects and under the conditions stipulated by generally binding legal regulations, in particular by Act No. 89/2012 Coll., the Civil Code, as amended, the buyer has the possibility to claim in the case of a claim, in particular that defective goods has been repaired or replaced for new items. In the case of an unjustified complaint, the customer pays the costs incurred by the operator by claiming goods.

h) Seller does not accept liability for damages resulting from the operation of products, functional properties and damages caused by improper use of the products as well as damage caused by external events and incorrect handling. Defects of this origin are not covered by the warranty.
i) The warranty does not cover defects caused by improper use, improper or inappropriate handling, use and installation that are inconsistent with the user manual or damaging the effects of overvoltage in the grid, natural elements or force majeure. The warranty also does not apply to damage equipment with excessive mechanical wear.

j) The warranty does not apply to wear and tear caused by its usual use.

k) The warranty does not apply to goods with damaged seals, information labels, serial numbers, etc.

 

10. Final provisions

1. These Business Terms and Conditions are valid as stated on Seller's website on the day of the electronic order submission. In the case of a permanent contractual relationship, the buyer has the right to withdraw from the contract if there is a substantial change in the conditions after signing the contract. Withdrawal is effective at the moment of delivery to the seller. By submitting an electronic order, the buyer accepts all the terms and conditions of the Business Terms and Conditions, as applicable on the date of dispatch of the order, as well as on the day of sending the order, a valid amount of the ordered goods. Purchaser is irrevocably bound for the period specified for delivery of the goods. The Participants agree that unless the terms are expressly provided otherwise, their rights and obligations are governed by applicable Czech laws.
